Supremes refuse to hear child porn appeal
AN ARIZONA TEACHER faces 200 years in jail after being caught with child porn images on his computer. Morton Berger claims the sentence ten years for each of twenty images, to run concurrently is disproportionate to his crime and is therefore unconstitutional.
Now the US Supreme Court has refused to hear an appeal by Morton even though had he not lived in Arizona or had been tried by a federal court, the sentence would have been much lighter.
Morton can consider himself lucky the state prosecutor demanded a 340 year sentence, but he now faces just 200 years with no possibility of a pardon or probation. His lawyers asked for an appeal as his sentence is longer than it would have been for rape or murder and therefore amounts to 'cruel and unusual punishment'.
According to the Child Welfare League of America, despite having the toughest child porn penalties in the US, Arizona ranks fifth nationally in the rate of children with substantiated reports of abuse and neglect, almost twice the national average.
And the Archives of Pediatric and Adolescent Medicine report that young children are more likely to die of child abuse or neglect in Phoenix than any other major metropolitan area in the US. ΅

Well this is staggering, i mean 10 years for each child pornography pictures?
He have 20 pictures in his computer, which means 200 years in prison?

man, i saw this story on 60minutes or some show like that with a kid that had something similar happen to him. this lawyer tried to put this 17yr old behind bars for life and beyond. i guess this kid was just lookin at some 'questionable' sites, but in doing so a hacker was able to comprimise his computer and start using it to host/hide thier kiddy porn. this kid was a total computer noob, so u could tell he wasnt in on it at all. that just really sucks, could u imagine someone wanting to put u behind bars for life when u technically didnt even do ANYTHING.

i remember reading about a man who photoshopped legal girls (18+) and made them look 14-16 years old, apparently he was also arrested. theres crazier crap out there this.
if this turns into americas war on child porn i certainly hope its nothing like the war on ************************s or the war on terror, they seem to have had the opposite effect.

although, i think in the case of the guy, whose computer got hacked, must've done something in regard that matter. because in court, they would have to proof beyond a reasonable doubt that he solely had nothing to do with what was found on his computer. who knows, maybe there's a deepper story than what it appears, maybe he allowed his hacker friends to host all their illegal sick kiddy pron on his computer. all i am saying is that in his case, it's hard to prove that he has absolutely nothing to do with it.
but all this just makes you think twice about even having any porn on your computer. but i definntely agree it's kinda ****ed up. the sentence you get for 20 pictures is worse than killing a man.
Well the way i look at it is that child pornography is way dangerous than, say, crack and other ************************s ;)
And owning child pornography is way dangerous of having a gun and if you're caught with child pornography you'd go to jail (in arizona, of course) and if you're caught with guns without permits then they just confiscated your guns :p

actually i've studies plenty of law cases that are sex related. since you don't live in this country, i can tell you that this country takes sex offense more seriously than murder and violence.
you get an ex-con as your neighbor, you might just not invite him to your BBQ. but you get a sex offender in your neighborhood as neighor, you can be sure that there'll be a linching party with bunch of red necks carrying their 12 gauge shot guns.

Arizona might be stricter in the sense that they were handing out 10 years per picture, but the rest of the states is pretty much just as bad.
Fulton man gets 20 years for child pornography
A Fulton man was sentenced today to 20 years in federal prison for receiving child pornography over the Internet.
Ernest Chip Holmes III, 42, of 3 Whitaker Road, already had pleaded guilty to the charge.
Investigators found more than 800 images on his lap-top computer that contained pornography involving children, said Lisa Fletcher, assistant U.S. Attorney.
I remember a while ago i read a story about how a teacher took a piss in a mens bathroom at the urinal, where 2 other boys were. Apparently they saw his ******************************, reported him, and he was sentenced to something like 10 years for exposing himself to a minor.
Here's another story about a woman getting 40 years for porn pop ups. Pretty much the entire united states is this crazy.
One thing I do find kind of funny is this, in georgia for example the legal age of consent is 16. So you can go and screw any 16 year old girl you desire, but in the united states as a whole, possessing any pictures of anyone under 18 is considered child pornography. So while you can screw your 16 year old girlfriend anywhere you want, if you get caught with any naked pics of her you're pretty much screwed.

plus i think the intention behind this is to keep USA out of child pornography. Countries like China and Russia are plagued with this issues that its going out of hand.
Since USA have the biggest pornography market (online, that's it) if there weren't any Anti-Child-Pornography legislation i couldnt imagine how many underage related porno there would be.

in one hand you have state government telling you what you can do, on the other hand you have your Federal governement contradicting it.
you have to consider this though ... if a person is sick enough to have child porn on their computer ... what else are they capable of? .... you could easily consider child porn a "gateway ************************" to rape and more.

I think that they shouldn't give punishments on possesing something thats legal and doesn't harm people. Maybe they have to pay a lot for each pic or something but this is ruining someone's life. I find child porn wrong and understand that they do this to avoid more of it being made. I mean YOU GET LESS YEARS IN JAIL FOR KILLING SOMEONE GODD*MNIT and then consedering so many absurd things that are punshed WAY to hard or shouldn't be punished. This is what we call American stupidness in Europe.

I can hardly believe things like that but i know such things happen. Besides i would give the lawyer 25 years in jail if possible for "destroying a possibly innocent person his life".

i'm guessing because people are stupid and think in black or white, your either with it or against it. if anyone out there started saying "hey we should be more lenient and base punishments on what people get caught with, and how old they are" the media would go apesh1t on them saying sh1t like "while we're trying to keep your children safe with stiff child pornography / abuse punishments, these people are trying to reduce them" or some such bull****.
i don't think anyone under 18 should get sent to jail for child porn, mainly because if you possess a picture of say a 17 year old girl thats butt neked, thats technically child porn and therefore their not considered adults.

Where did he get the pictures from though? I mean if he took the pictures him self then I see this as a fitting punishment, but if he just downloaded them from the internet than it might be a little harsh.
